Planning

Milton Keynes City Council (MKCC) as a local planning authority is required to undertake a formal period of public consultation, prior to deciding a planning application.  The formal consultation period will normally last for 21 days, and MKCC will identify and consult a number of different groups.

Consultees

  • Public: including consultation with neighbouring residents and community groups.
  • Statutory: where there is a requirement set out in law to consult a specific body. (Examples: Parish, Town and Community Councils, Canal & River Trust, Environment Agency, Health & Safety Executive, Historic England, etc)
  • Non-statutory: where there are planning policy reasons to engage other consultees who – whilst not designated in law – are likely to have an interest in a proposed development. (Examples: Police & Crime Commission, Sports England, Ministry of Defence, etc.).

Finally, once consultation has concluded, the local planning authority will consider the representations made by consultees, and proceed to decide the application.

Who is eligible to respond to a consultation?

Anyone can respond to a planning consultation. In addition to individuals who might be directly affected by a planning application, community groups and specific interest groups (national as well as local in some cases) may wish to provide representations on planning applications.

An annual list of all planning applications for Fairfields Community Council will be accessible for all via our website, or alternatively, residents also have access via MKCC website to view all applications and comments.

Licensing

Milton Keynes City Council (MKCC) as a local licensing authority is responsible for issuing a number of variety of licences for example:

Alcohol, Entertainment, Events, Street Trading, Premise License, Gambling, Animals

Taxis

MKCC consults for a period of 28 days with the following main bodies:

  • The local Town / Parish / Community Council in whose area you are planning to trade.
  • The Environmental Health Division.
  • Thames Valley Police.
  • Highways (where you are trading on the road / roadside)
  • The Council Dept who manages the land concerned (where you believe you are seeking to trade on Council land).
  • The Councils Estates Division for car parks / community halls / shops where they are nearby to your proposed trading location.
  • The Milton Keynes Councillor for the area concerned.
  • The landowner where you are on private land.
  • In addition, you should also consider if your trading location is likely to cause a traffic / road safety issue as this will be taken as a relevant factor on any application.

Boroughwide consents allow for no more than 20 minutes trading in any 100 metre part of any one Consent Street on any one day. (Examples of these would be ice cream traders, mobile coffee and snack vans, burger and fish and chip vans, etc.).

Street Trading is prohibited within 250 metres of any school’s entrances and/or exits, during main school hours and 30 minutes following a school’s normal closing time. Main school hours means, the normal opening times for any particular school, whilst the students are being educated including lunch breaks but does not include times when the premises are open for after school activities. The prohibition applies to all school types such as; Infant, Junior, Primary, Secondary, Academy, Special, College and applies to static street traders (i.e. kebab vans) and Boroughwide street traders (i.e. ice cream vans). The effective date of the prohibition is from the 26 April 2019.
